Terms of Service

1. Who provides Gary

Gary is provided by Pleso Therapy sp. z o.o. (“Pleso”, “we”, “us”), a company registered in Poland (KRS 0000980227, REGON 522652856, NIP 5783155594), registered office ul. 12 Lutego 25/7, 82-300 Elbląg, Poland. Contact: hq@pleso.me.

2. What Gary is - and is not

Gary is a general-wellbeing companion: a friendly, supportive space to take the edge off between the moments that matter. It can offer short calming audio, gentle check-ins, and simple self-help tools.

Gary is NOT:

• not a medical device, and does not diagnose, treat, cure, monitor, or predict any medical or psychological condition;
• not therapy and not a substitute for professional care, diagnosis, or treatment by a qualified professional;
• not an emergency or crisis service. Gary cannot provide urgent help. If you or someone else may be at risk, contact the support routes shown in the app - in the UK, Samaritans on 116 123 (free, 24/7), NHS 111, or 999 in an emergency.

Anything Gary says is for general wellbeing and informational purposes only. Always seek the advice of a qualified professional with any questions about a medical or mental-health condition.

3. Eligibility

Gary is for adults aged 18 or over. By using Gary you confirm you are 18+. Gary is not intended for, and must not be used by, anyone under 18.

4. Your account

You can use Gary as a guest (an anonymous account on your device) or sign in with Google. You are responsible for keeping access to your account and device secure. Some content (your chat, daily mood, and “key moments”) is stored on your device; clearing your browser data removes it. How we handle your data is explained in our Privacy Policy.

5. Acceptable use

You agree not to:

• use Gary for anything unlawful, harmful, or abusive, or to harass or harm others;
• attempt to break, overload, reverse-engineer, scrape, or gain unauthorised access to Gary or its systems;
• misrepresent your identity or age, or use Gary on behalf of someone under 18;
• rely on Gary for medical, legal, or other professional advice, or in an emergency.

We may suspend or end your access if you materially breach these Terms or use Gary in a way that risks harm to you, others, or the service.

6. AI-generated content

Some Gary features use artificial intelligence to generate responses and audio (see the Privacy Policy for how this works and how your data is handled). AI-generated content can be imperfect or inaccurate, is not professional advice, and should be treated as general wellbeing support only. You are always told when you are interacting with AI.

7. Content and intellectual property

Gary, its content, design, and software are owned by Pleso or its licensors and are protected by law. We grant you a personal, non-exclusive, non-transferable, revocable licence to use Gary for your own personal, non-commercial wellbeing. Content you create in Gary (for example your “About you” note) remains yours; you grant us the limited permission needed to store and process it to provide the service, as described in the Privacy Policy.

8. Privacy

Your privacy matters. How we handle your data - including special-category health data and AI processing, on the basis of your explicit consent - is described in our Privacy Policy and Cookie & Third-Party Tools Policy, which form part of your agreement with us.

9. Availability and changes

We may change, suspend, or discontinue Gary or any feature at any time, and we may update these Terms. If we make a material change to the Terms, we will let you know in the app. Continued use after a change means you accept the updated Terms.

10. Disclaimers and liability

Gary is provided “as is” and “as available”, without warranties of any kind to the fullest extent permitted by law. We do not warrant that Gary will be uninterrupted, error-free, or fit for any particular purpose.

To the fullest extent permitted by law, we are not liable for any indirect, incidental, or consequential loss, or for any reliance you place on Gary or on AI-generated content. Nothing in these Terms limits or excludes liability that cannot be limited or excluded by law - including liability for death or personal injury caused by negligence, or your statutory rights as a consumer.

11. Termination

You can stop using Gary and delete your account at any time in Account settings. We may end or suspend your access as described in section 5. Sections that by their nature should survive (for example intellectual property, disclaimers, liability, and governing law) continue after termination.

12. Governing law and disputes

These Terms are governed by the law of the Republic of Poland. If you are a consumer, this does not deprive you of the protection of the mandatory consumer-protection rules of the country where you live, and you may be able to bring proceedings in your home courts.

13. Changes to these terms

We may update these terms as Gary evolves and will change the “last updated” date above. Continued use after a change means you accept the updated terms. Questions? Contact us at hq@pleso.me.
